We require service providers handling personal information on our behalf to use it only for the services we request and to implement reasonable safeguards.

5.2 Business Transfers

In the event of a merger, acquisition, asset sale, or financing, personal information may be transferred as part of the business transaction, subject to confidentiality protections.

5.3 Legal & Safety Disclosures

We may disclose information when we believe in good faith that doing so is necessary to:

  • Comply with applicable law, regulation, legal process, or governmental request.
  • Respond to emergency situations threatening life, health, or property.
  • Protect Apex Plumbing, our customers, technicians, or the public from fraud, harm, or illegal activity.

We retain personal information for as long as reasonably necessary to:

  • Complete the plumbing services you requested and maintain accurate service history.
  • Comply with tax, accounting, and legal obligations.
  • Resolve disputes and enforce agreements.

We use criteria such as the nature of the data, the purpose of collection, legal retention requirements, and operational needs to determine retention periods. When data is no longer required, we take steps to delete, anonymize, or securely archive it.

7. Data Security

We take reasonable administrative, technical, and physical safeguards to protect personal information, including:

  • Role-based access controls for customer and billing systems.
  • Password and authentication safeguards; multi-factor authentication where available.
  • Device and software security (firewalls, antivirus, patch management).

  • Vendor due diligence, including security commitments from payment processors and IT providers.
  • Secure disposal of records containing personal information when no longer required.

No system can be guaranteed 100% secure. We encourage you to use unique credentials and to notify us promptly of any suspected unauthorized activity involving your information.

8. Cookies, Analytics & Online Tracking

8.1 What Are Cookies?

Cookies are small data files stored on your browser that help websites function, remember preferences, and understand usage patterns.

8.2 Types of Cookies We May Use

  • Strictly Necessary Cookies: Site operation (forms, navigation, session management).
  • Preference Cookies: Remember saved info (e.g., service address).
  • Analytics Cookies: Measure traffic and usage (e.g., Google Analytics, privacy settings configured for IP masking where feasible).
  • Advertising Cookies (Limited Use): Used only if we run localized digital marketing or retargeting campaigns.

8.3 Your Choices

Most browsers let you block or delete cookies. Doing so may affect site functionality. You can also install browser add-ons (e.g., Google Analytics Opt-out Browser Add-on) to limit analytics tracking.

8.4 Do Not Track

Our website does not currently respond to browser “Do Not Track” signals. We will update this Policy if that changes.

9. Text Messages, Calls & Automated Communications (TCPA Notice)

We may use phone calls or SMS/text messages to communicate about service appointments, technician arrival windows, urgent job updates, billing, or limited promotional offers.

Consent: By providing your mobile number to Apex (online form, phone call, text-in keyword, or written agreement), you consent to receive communications at that number. Consent to marketing texts is not a condition of purchasing services.

Opt-Out: You may opt out of marketing texts at any time by replying STOP. Service/transactional texts (e.g., "Technician en route") may still be sent where permitted to complete scheduled work you requested. For help, reply HELP or contact us using Section 15.

Quiet Hours: We do not intentionally send marketing texts or calls before 8:00 AM or after 9:00 PM local time, consistent with telemarketing best practices.

Recorded Lines / Voicemail: Calls may be recorded for quality and training. If we ever use prerecorded or artificial/automated voice messaging, we will obtain appropriate consent as required by law.

10. Email Communications & CAN-SPAM Notice

If you provide your email, we may send:

  • Service confirmations, invoices, and required transactional notices.
  • Periodic maintenance reminders, service tips, promotions, discounts, and seasonal alerts.

Commercial (marketing) emails from Apex will:

  • Identify Apex Plumbing as the sender.
  • Include our valid physical mailing address.
  • Provide a clear unsubscribe or opt-out method that works.
  • Be honored within a reasonable period (typically 10 business days or sooner).

You can unsubscribe by using the link in any marketing email or by contacting us (Section 15). Transactional or service-related emails may continue where required to provide Services you have requested.

11. Florida Residents: Data Security & Breach Notification

Under Florida law, businesses that maintain certain categories of personal information in electronic form must take reasonable measures to protect that data and, in many cases, notify affected Florida residents and (if thresholds are met) the Florida Department of Legal Affairs (Attorney General) when a data security breach occurs.

If Apex Plumbing determines that a breach involving covered personal information has occurred and presents a risk of harm, we will provide required notices within applicable timeframes (generally no later than 30 days after determination, subject to authorized delay), and will include the basic information required by law (date or date range of breach, types of data involved, and how to contact us). We may also notify consumer reporting agencies when required.

12. About the Florida Digital Bill of Rights (FDBR)

Florida has enacted the Florida Digital Bill of Rights (SB 262), which imposes data privacy obligations on certain large for-profit entities with over $1 billion in global annual revenue that meet additional criteria (e.g., large ad platforms, smart speaker operators, app store operators). These provisions are primarily directed at very large technology and digital businesses.

Small & Local Businesses: Based on what we know about Apex Plumbing as a local Florida plumbing company, we do not believe the primary controller obligations of the FDBR currently apply to us. However, we voluntarily provide transparency through this Privacy Policy and will monitor for regulatory updates.

13. Your Privacy Choices & Requests

While Florida does not (yet) grant broad, California-style consumer privacy rights to all residents, Apex offers the following voluntary choices:

Access / Review: You may request a summary of the contact and service information we maintain about you.

Corrections: Ask us to update or correct inaccurate contact or service records.

Deletion: Request deletion of personal information that is not required for:

  • Completing active or scheduled service work.
  • Legal, tax, warranty, or safety record-keeping.
  • Defending legal claims.

Marketing Opt-Outs: Unsubscribe from marketing emails; reply STOP to marketing texts; ask to be added to our internal “Do Not Contact” list.

Cookies & Tracking: Adjust browser settings or use third-party tools to limit cookies/analytics. (See Section 8.)

To submit a request, see Section 15.

14. Children’s Privacy

Our Services are not directed to children under 13 and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete it. Parents or guardians who believe their child has provided information to us may contact us (Section 15) to request review or deletion.

15. Contact Us

Questions or requests about this Privacy Policy? Please contact us.

  • Apex Plumbing
  • Info@Apexplumbingflorida.com

16. How We Verify & Fulfill Requests

To protect your privacy, we take steps to verify your identity before fulfilling certain requests (e.g., access or deletion). Verification may include matching name, service address, recent service date, or contact method previously used with us. Authorized agents must provide signed authorization and may be required to confirm with the customer directly.

17. Recordings, Photos & Onsite Job Data

For training, safety, and documentation, technicians may collect job-site photos or short video clips (e.g., damaged pipes, before/after repair). These materials are tied to the service record and may include incidental images of the surrounding property. We use these only for documentation, warranty, training, quality assurance, or dispute resolution unless you provide written permission for marketing use.

If you do not want job-site media used for marketing, please let us know—default is no marketing use without your express authorization.

18. Data Transfers

We operate in the United States. If you are located outside Florida and choose to provide information to us, your data will be transferred to, stored, and processed in the United States where our systems and service providers are located.

19. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, applicable laws, or service offerings. When we do:

  • We will update the “Last Updated” date at the top of this page.
  • If changes are material, we will provide a more prominent notice (e.g., website banner, email notice if we have your email).
  • Continued use of the Services after the effective date of an updated Policy means you acknowledge the revised Policy.
